MASTER SERVICE TERMS & CONDITIONS

These Terms and Conditions (“Agreement”) apply to all services provided by S.O.S Trades Pty Ltd (“Contractor”, “we”, “us”, “our”).
By booking, accepting a quote, or requesting attendance, the Client (“you”, “your”) agrees to be legally bound by this Agreement.

- $0 CALL-OUT FEE – BUSINESS HOURS
1.1 A $0 call-out fee applies strictly during:
- Monday to Friday
- 8:00am – 5:00pm
- Excluding public holidays
1.2 The $0 call-out applies only within 25km metropolitan radius of our business location.
1.3 The $0 call-out fee covers attendance only. It does NOT include:
- Labour
- Diagnostics
- Materials
- Equipment usage
- Specialist services
- Travel outside 25km
1.4 We reserve the right to withdraw the $0 call-out offer at any time.

- AFTER HOURS, WEEKENDS & PUBLIC HOLIDAYS
2.1 The following are classified as After Hours:
- Before 8:00am or after 5:00pm weekdays
- Saturdays
- Sundays
- Public holidays
- Long weekends
2.2 After-hours services incur:
- A call-out fee
- Higher labour rates
- Applicable surcharge loadings
2.3 These charges are determined by our current pricing schedule at the time of booking.

- EMERGENCY ATTENDANCE
3.1 Emergency services include but are not limited to:
- Burst pipes
- Gas leaks
- Flooding
- Major drainage blockages
- No hot water in urgent circumstances
- Any safety risk
3.2 Emergency call-out fees are variable and based on:
- Technician location
- Travel distance
- Time required to reach site
- Time of day
- Traffic conditions
- Weekend or holiday loading
3.3 Emergency call-out fees will be disclosed where reasonably practicable prior to dispatch.
3.4 By requesting emergency attendance, you agree to the applicable fee.

- NON-REFUNDABLE CALL-OUT FEES
4.1 Any call-out fee becomes strictly non-refundable once:
- The technician is dispatched
- Travel has commenced
- The technician arrives on site
- Time allocation has been reserved
4.2 Call-out fees cover:
- Travel time
- Fuel
- Vehicle wear
- Scheduling
- Administration
4.3 Call-out fees remain payable regardless of:
- Whether work proceeds
- Whether quote is accepted
- Whether issue is minor
- Whether access is denied
- Whether repair is declined
4.4 Cancellations after dispatch may incur the full call-out fee.

- CANCELLATION POLICY
5.1 Minimum 24 hours’ notice is required to cancel a booking during business hours.
5.2 Same-day cancellations may incur:
- A minimum service charge
- Full call-out fee if dispatched
5.3 Emergency bookings cannot be cancelled once technician has been allocated.

- QUOTATIONS & VARIATIONS
6.1 Quotes are valid for 7 days unless otherwise stated.
6.2 Variations due to unforeseen conditions (hidden pipe damage, non-compliant installations, structural issues) will be charged separately.
6.3 Additional work will not proceed without approval where required under ACL.

- PAYMENT TERMS
7.1 Payment is due immediately upon completion unless otherwise agreed in writing.
7.2 We accept:
- Cash
- EFT
- Credit/Debit card (surcharges may apply)
- Approved finance
7.3 Commercial clients may receive 7-day payment terms (subject to approval).

- LATE PAYMENT & DEBT RECOVERY
8.1 Overdue invoices may incur:
- 10% per annum interest
- Administrative fees
- Debt collection costs
- Legal costs
8.2 The Client agrees to indemnify the Contractor for recovery costs.
8.3 We reserve the right to lodge payment defaults with credit reporting agencies where permitted by law.

- ACCESS & SITE CONDITIONS
The Client must:
- Provide safe access
- Restrain pets
- Ensure clear work area
- Provide access to utilities
- Ensure legal compliance of existing installations
Unsafe sites may result in refusal of service while still charging call-out fees.

- LIMITATION OF LIABILITY
To the maximum extent permitted by law:
10.1 Our liability is limited to:
- Re-supplying the services; or
- Paying the cost of having services supplied again.
10.2 We are not liable for:
- Indirect or consequential loss
- Loss of income
- Loss of rental
- Property damage due to pre-existing faults
- Hidden defects
- Pre-existing non-compliant plumbing
10.3 We do not guarantee that existing systems will comply with current regulations unless specifically contracted to upgrade them.

- WARRANTIES
11.1 Workmanship warranty applies in accordance with South Australian legislation.
11.2 Manufacturer warranties apply to supplied products only.
11.3 Warranty is void if:
- Another contractor interferes
- Client misuse occurs
- Lack of maintenance
- External damage

- FORCE MAJEURE
We are not liable for delays caused by:
- Weather
- Traffic
- Natural disasters
- Government restrictions
- Supply chain delays
- Events beyond reasonable control

- SOUTH AUSTRALIA COMPLIANCE
All plumbing and gas work is carried out in accordance with:
- South Australian licensing requirements
- Australian Standards
- Plumbing Code of Australia
- Australian Consumer Law

- SEVERABILITY
If any clause is found unenforceable, the remaining provisions remain valid.

- ENTIRE AGREEMENT
This document forms the entire agreement and overrides prior discussions.
